These Terms & Conditions (these “Agreements”) Govern the Wheelin Pete’s Green Coffee Company’s Shipping & Returns, Privacy Policy & Member Programs

Shipping & Returns

Shipping
All orders are shipped within 1 business day of receipt of order by United States Postal Service (USPS) shipping method identified at checkout. The Shipping tracking number will be sent to your e-mail address when Wheelin Pete’s Green Coffee Company receives the tracking # from USPS.

Returns
Green Coffee Beans are not returnable for a refund.  However, we guarantee your satisfaction so we will gladly replace your purchase with another coffee if you return the unused portion within 15 days of purchase.

Coffee Roasters are returnable within 90 days of date of purchase for a full refund, credit, or exchange. The roaster must be returned in good condition, with all parts and instructions, in the original packaging, with return postage paid and insured. You must contact us at [email protected] to get a return authorization prior to shipping. Please provide a contact phone number so we may contact you with any questions.

Privacy Policy

Information Collection, Use, and Sharing
We are the sole owners of the information collected on this site. We only have access to collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.

Orders
We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.

Sharing
We may use an outside shipping company to ship orders, and we use a credit card processing company, PayPal, to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order.

Surveys, Contests & Free Reports
From time-to-time our site requests information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site. Information provided to receive free reports will be used to send the free reports and contact you about our product/s.

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

WheelinPetesGreenCoffee.com is proud to announce we use PayPal as our payment processor so all information you provide for payment processing is seamlessly processed at WheelinPetesGreenCoffee.com via PayPal’s secure system.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Member Programs

The Wheelin Pete’s Green Coffee Company Member Programs are a loyalty program brought to you by Wheelin Pete’s Green Coffee Company, (collectively “we,” “us,” “our,” “ours”). Purchase or use of any membership in the Wheelin Pete’s Green Coffee Company Member Programs (“Membership”) at any time subjects the purchaser or user (“you,” “your,” “yours,” “Member”) to the provisions of this Agreement, as amended from time to time.

Benefits
The Wheelin Pete’s Green Coffee Company Member Programs entitles Members to the following benefits:

• ACCESS TO OUR PRIVATE ONLINE COMMUNITY
• SELECTED COFFEE SHIPMENTS ONCE A MONTH INCLUDING FREE SHIPPING
• DISCOUNTED AND/OR FREE ROASTING PROFILE DOWNLOADS
• DISCOUNTS ON ALL BEANS
• ADVANCED COFFEE OFFERINGS NOTICES AND/OR SHIPMENTS
• MEMBERS ONLY PROMOTIONS
• ALL MEMERSHIPS OFFER SECURE CHECKOUT & CANCELLATION AT ANY TIME, NO QUESTION ASKED*

*Some conditions apply to annual memberships whose purchase is required to secure a free item such as a coffee roaster.  You may cancel your membership at any time but the promotional item will be charged against your membership payment prior to the return of any remaining membership fees which will be prorated according to the current monthly fee.

Business Days are Monday through Friday, excluding holidays observed by the Post Office and USPS, such as New Year’s Day, Presidents’ Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas.

Orders are shipped within one business day of your online order. Delivery times are not guaranteed. Sometimes the availability of the items in your order may change while we are processing your order. In this event, you will receive an email notifying you of a delay, and the remaining eligible items in your order will be shipped as scheduled.

Certain Conditions
• For the Member Discount, or other benefit to apply, the Membership account must be active and available at the time of purchase. Members will NOT be reimbursed retroactively for purchases made without an active and available Membership at the time of purchase.
• Member Discount will be applied after all eligible discounts and Coupon discounts will be applied after the Member discount.
• Memberships are for individual use only and are non-transferable.
• We expect Members to submit and maintain accurate and current user information in connection with their Memberships. Such information includes name, address, email address, and telephone number. Members can change their account information by sending an email to [email protected] We cannot assume any liability for e-mail that is lost, delayed, or misdirected.

Membership Fees
We may change the Membership fees at any time, but changes will apply only to new and renewal Memberships. Membership fees are not refundable.

Term; Automatic Renewal; Billing
The Membership term is one month, beginning on the date of purchase. A Renewal or Automatic Renewal within a current Membership term extends the existing expiration date of the Membership by one month; such renewal term begins the day after the current term ends. When an expired Membership is renewed, the new Membership term is one month, beginning on the date of renewal. For promotions which require a one year membership purchase the term is one year. All of the following terms should be considered annual if applicable to your membership purchase. After the first year you may contact us to switch your membership billing to monthly or quarterly otherwise is will remain on a one year schedule.
Each Membership will automatically renew (referred to as “Automatic Renewal Membership”) each month for additional one-month periods that commence on the day after the previous term ends unless you have notified us at least 5 business days prior to your renewal date at [email protected]

Automatic Renewal Membership fees will be billed monthly and automatically to the credit or debit card (other than a debit card that always requires a PIN) you provided when you enrolled in Membership or the form of payment we currently have on file for you, in the amount of the then current Membership fee.

When you enroll in Membership online at Wheelin Pete’s Green Coffee Company, the then current Membership fee will be billed to: (i) the form of payment we currently have on file for you that was active in your Wheelin Pete’s Green Coffee Company account at the time of the enrollment or the renewal, (ii) the form of payment we currently have on file for you that you provided to us when making a purchase with your Member card at Wheelin Pete’s Green Coffee Company, or (iii) the form of payment we currently have on file for you that you updated through [email protected]

Cancellation; Termination
• You have the right to cancel your Membership at any time. If you cancel your Membership, you must notifiy us at least 5 business days prior to your renewal date at [email protected]

• We may terminate your Membership, including any associated accounts, without notice, for any reason in our sole discretion, including without limitation our belief that continued use of such Membership would violate any provisions of this Agreement, applicable law, or otherwise be harmful to our interests. In the event of any such termination, you will not be entitled to a refund of your Membership fee.

• We may terminate any or all of the benefits available under the Wheelin Pete’s Green Coffee Company Member Program at any time with or without notice. In the event of our termination of the Wheelin Pete’s Green Coffee Company Member Program, at our election, we will either maintain your Membership benefits until expiration of the Membership current term or refund each Member a pro rata portion of the Membership fee for the remaining portion of the current Membership term.

Member Privacy Policy
As a Member, the information we capture will be subject to the Wheelin Pete’s Green Coffee Company Privacy Policy as amended from time to time in accordance with its terms. You may view the current version of the Wheelin Pete’s Green Coffee Company Privacy Policy as part of our Terms & Conditions above.

Disclaimers; Limitation of Liability
USE OF THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM AND ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. THE MEMBERSHIP BENEFITS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WHEELIN PETE’S GREEN COFFEE COMPANY, AND ALL OF THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS AND AGENTS (COLLECTIVELY “MEMBERSHIP PROVIDERS”) EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

MEMBERSHIP PROVIDERS MAKE NO WARRANTY THAT (i) THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU FROM YOUR USE OF THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM WILL MEET YOUR EXPECTATIONS.

MEMBERSHIP PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MEMBERSHIP PROVIDER HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM OR ANY BENEFITS THEREOF; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM DATA; OR (iv) ANY OTHER MATTER RELATING TO THE WHEELIN PETE’S GREEN COFFEE COMPANY MEMBER PROGRAM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Governing Law
This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of California, without regard to conflict of law principles.

Binding Arbitration
Any controversy or claim arising out of or relating to this Agreement (including any breach thereof) or the Wheelin Pete’s Green Coffee Company Member Program shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (including without limitation the Supplementary Procedures for Consumer-Related Disputes), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated with any claim or controversy of any other party. The foregoing shall not preclude Wheelin Pete’s Green Coffee Company, from seeking any injunctive relief in State or Federal courts for protection of their respective intellectual property rights (including such rights of their respective licensors).

Acknowledgement
This Agreement, including all documents referenced herein, represents the entire understanding between us and any user of the Wheelin Pete’s Green Coffee Company Member Program with respect to the Wheelin Pete’s Green Coffee Company Member Program and supersedes any other agreements, statements or representations. Headings used in this Agreement are for reference only and shall not affect the meaning of any terms. Any user of any portion of the Wheelin Pete’s Green Coffee Company Member Program is deemed to have accepted the terms and conditions of this Agreement.

Changes to This Agreement
We may change the terms of this Agreement at any time without notice or liability by posting a revised Agreement at Wheelin Pete’s Green Coffee Company website under Term & Conditions.  Any change shall take effect immediately, unless otherwise provided.
